The Penang (frigate) . was built at Prince of Wales Island, for. His Majesty's service, but the island not affording the requisite stores to fit her out, Lord MINTO directed that she should take in a cargo of goods on the East India Company's account, the freight of which would considerably decrease the expence of her building to the public

I'm not convinced. In Jan 1809, prior to being launched, there is a reference to the Malacca, 1809 Jan 31 "William Wellesley Pole. The ordnance and stores for the Malacca frigate, currently loading by East Indiamen for Prince of Wales Island, should be consigned to the Governor and Council" ADM 354/235/120.
The fact that the Penang was commanded by an EIC Officer in 1810 strongly suggests two different ships. I can not see how a British warship is ever under the command of a merchan t officer.

We understand, that the Honorable Company's Frigate Penang, Captain Tremenhetre, is to be one of the fleet expected to be dispatched fur Euglaud, about the middle of next mouth

I'm afraid you are confusing two different vessels. The Malacca, a RN frigate, launched in 1809 and renamed from Penang before launch and this Penang which is an EIC ship as stated.

'Penang' was the first ship built in Penang for the Royal Navy. Launched 13 August 1809 it was a 36-gun frigate, later renamed 'Malacca' when taken up by the Admiralty. It did not belong to EIC as stated above.
