I'm not convinced. In Jan 1809, prior to being launched, there is a reference to the Malacca, 1809 Jan 31 "William Wellesley Pole. The ordnance and stores for the Malacca frigate, currently loading by East Indiamen for Prince of Wales Island, should be consigned to the Governor and Council" ADM 354/235/120.
The fact that the Penang was commanded by an EIC Officer in 1810 strongly suggests two different ships. I can not see how a British warship is ever under the command of a merchan t officer.

The Malacca was launched in Penang 13 August 1809, the only ship to be built for the Navy in Penang. It was originally named 'Penang' but later changed to 'Malacca' when Admiralty took it over.

May 1812 Captain Peachey assumed command of Sir Francis Drake and sailed her back to England as escort to a convoy of returning East Indiamen. At that time, Captain Samuel Leslie (acting) of Volage replaced Peachey. Shortly thereafter Captain Donald Hugh Mackay replaced Leslie.
